Alhaji Yusha’u Ibrahim of the People’s Democratic Party (PDP), has been confirmed by a Kaduna State High court on Wednesday as the elected Chairman of Birnin Gwari Local Government in Kaduna State.

Justice Binta Zubair, who delivered the ruling, dismissed the application by the Kaduna State Independent Electoral Commission (KADSIEC) asking it to set aside the court’s earlier order compelling it (KADSIEC) to give Ibrahim a certificate of return.

The Judge also confirmed Abdulkadir Umar as the Councillor to represent Kazage Ward in the same local government, and ordered KADSIEC to issue him a certificate of return.

The News Agency of Nigeria(NAN) reports that the court had earlier ordered KADSIEC to issue a certificate of return to Ibrahim.

The order was, however, not carried out as KADSIEC approached the court with a plea to quash the order.

Ms Mercy Umar, the counsel representing Ibrahim and Umar, who spoke to NAN on the judgement, said her clients won because the Judge found no merit in the application made by KADSIEC.

“The first matter was about a motion brought in by KADSIEC asking the court to set aside an earlier judgement delivered by the same court on that matter.

“In her ruling, she found no merit in the application they made and dismissed it.”

She added that the second matter was in respect of Kazage ward where the PDP candidate, who won, was not given a certificate of return.

Efforts to speak with Mr Sulaiman Hassan, who appeared for the electoral body, did not yield fruits as he left the court premises immediately after losing the case.
